We start with an in depth interview with you to see if indeed bankruptcy is the solution to your financial woes. Surprisingly, for some people, bankruptcy is not the best solution. For them, it's only a matter of taking a different perspective on their money matters. Not all people need to file for bankruptcy relief. Some of the other alternatives include: seeking out loan modification, selling certain high equity assets, working out a payment plan with the credit company, debt restructuring, and re-negotiating the business lease. Bankruptcy is truly a last resort. It should not be the first option to be considered.
Once it is determined that the bankruptcy is a good fit for you, then we start on the paper work and determine the best timing for your filing. In doing the paperwork, we first pull your credit report to make sure we include all your creditors (all the money you owe) and that the correct amounts are recorded. Bankruptcy petition requires a vast number of data relating to your assets, debts, income, and expenses. We help you understand the concept and relevance of each category of information required. We also help you in locating the needed information (such as where you can find certain data).
The Bankruptcy Code also requires that you to take two separate financial management courses. The courses are intended to help you learn about your own financial situation and to ensure that you will not have to file for bankruptcy relief the next time around. The effectiveness of the courses are still being debated. At any rate, we help you take the courses here at our office. We provide the additional explanations as to the various learning tools found within the courses. You can, of course, take the courses on your own through the internet as well.
If you are facing foreclosure, eviction, or a civil litigation, we will help you by providing you a clear guidance as to what your options are. We explain to you the events taking place and discuss with you to plot out the best course of action. Most important, we will not leave you in despair. There is hope. Once you survive through the ordeal, you will emerge stronger and "happier". We are here to talk to you. We believe every people are beautiful and worthy of compassion.
If you are a small business owner, we start with your income statement and balance sheet. We look at how much money the business is making and what the expenses are. We also examine your balance sheet to see if the business can be saved. Although we are not able to make any promises, it's been our experience that the U.S. Trustee has been quite reasonable in allowing small businesses to continue to operate through the owner's bankruptcy. When certain conditions are met, oftentimes, the business will survive the owner's bankruptcy unscathed.
Preparation of the petition takes anywhere between 2 weeks to 2 months. The actual bankruptcy, once the petition is filed, usually takes about 4 months. If there are complications in your petition, your case may take a few months longer before a discharge is given. During those roughly 6 months time period, we will be your best friend. We will get to know your financial situation better than anyone else. We promise not to smirk, make fun of, or otherwise make light of your quandry. Rather, we will stay with you until the end and see to it that you are given a clean slate, a new life. You can always buy us pizza when it is all done and over with. Make sure at least one of them is Hawaiian (with ham and pineapples).
